This Privacy Policy does not apply to data we process on behalf of clients when acting as a data processor or service provider. 4.   Role as Data Controller vs. Data Processor

4.1.Data Controller

We act as the Data Controller when collecting personal data through website visits, marketing activities, customer interactions, and event participation.

4.2.Data Processor

When You use the LOXY Platform services and provide data, We process this data on Your behalf, under Your instruction, and as governed by the Data Processing Agreement (DPA). You can request access to our Data Processing Agreement (DPA) through our Trust Center.

By using Our Services, You acknowledge and agree to the terms of this Privacy Policy, which We may update periodically. When a contract is entered into, You confirm that You have obtained all necessary consents for Us to use personal data from individuals who interact with Our Services on Your behalf—such as account administrators, purchasing and invoicing contacts, authorized signers, and users of the Services ("Users")—and that these consents cover the disclosure of both personal and location data. You also authorize and expressly permit Us to provide Our Services using, storing, and transmitting this data as specified in the contract.

When We process data on behalf of clients within the LOXY Cloud Web App, LOXY 4Drivers, LOXY 4Tracking, LOXY 4Worktime, and other LOXY modular solutions, We act strictly as a Data Processor, following the instructions and purposes defined by You, the client. This data is collected, stored, and managed in full alignment with Your policies and the specific terms outlined in Our Data Processing Agreement (DPA). Data collected in this capacity is used solely for the purposes defined by You, and We do not determine or alter the scope or objectives of the processing. For comprehensive details on our data processing practices and commitments, You can request access to our Data Processing Agreement (DPA) through our Trust Center.

7.   How We Use Your Data: Purposes and Legal Basis

We may use the data We collect from You when You sign up for Our services, subscribe to Our newsletter, respond to surveys or marketing communications, browse Our site, request information about Our offerings, or interact with specific site features for various purposes. We encourage Users to take responsibility for safeguarding their devices, ensuring they are protected against harmful software, viruses, and worms, especially when accessing SATCOM Services, including the LOXY website, LOXY Apps, and the LOXY Platform.

10. Do We Share Your Personal Information?

Once Your personal information is collected, as outlined above, We may share it with third parties for specific purposes essential to operating Our business and delivering SATCOM Services. This includes services like email delivery, data hosting, analytics and payment processing. These third-party services may also collect browsing data, such as IP addresses, referring pages, and navigation information on Our Website.

The LOXY Websites, LOXY Apps, and LOXY Platform are hosted by trusted third-party providers who may process personal information submitted through these channels.

10.4. Use of Artificial Intelligence (AI) on Our Platforms

We utilize third-party providers for certain AI-based products, including the LOXY AI chatbot and LOXY AI CBO, available on Our websites. By engaging with these services, You acknowledge that any input You provide, which may include personal data, is shared with these providers to enable the intended functionality. Among these providers is OpenAI, LLC; review their privacy policy here.

We only share data with AI providers to support service functionality, without using Your data to improve or enhance Our services. Moreover, We do not access or retain inputs or outputs from interactions with the LOXY AI chatbot or LOXY AI CBO, nor do We collect data that could personally identify You. The terms of use and privacy policy of Our AI providers ensure that Your information is neither used for training AI models nor accessed for any other purpose.

10.5. Payment and Fraud Processing

We use Stripe as Our primary third-party payment processor to handle payments made through Our website securely. Stripe processes payments on Our behalf and adheres to strict data protection standards to safeguard Your information. Review their privacy policy here.

For regulatory, legal, tax compliance, or customer support purposes, We may store partial payment information, such as the expiration date and the last four digits of Your credit card number. Full payment details, including Your name, address, and phone number associated with the payment method, are securely stored by Stripe. Access to these details is restricted to select SATCOM personnel, who may only view the information if their role necessitates it, and they are bound by strict confidentiality agreements and data protection protocols.

SATCOM does not store Your complete payment data, such as full credit card numbers.

In cases of suspected fraud, Your information may be shared with relevant financial institutions and authorized entities strictly for fraud detection and prevention. Please note that data transfers may involve moving information outside of Switzerland or the European Union, where data protection laws may differ. Countries outside these regions may not provide the same level of data protection as those within the EU or Switzerland.

10.6. Marketing and Analytics Partners

Some third parties help Us measure and enhance Our marketing efforts, such as tracking email delivery and analyzing engagement. This includes recording whether recipients open emails and engage with links or content, allowing Us to improve future communications.
